Statement:
I generally take a different approach to mediation than most mediators. My crystal ball is no better or worse than other mediators (the reality is, no one has a good crystal ball). My undergraduate education is in engineering. Engineering is applied problem-solving. My graduate degree is in business and finance. Finance is about risk assessment and management. When clients typically enter mediation, they seek clarity and possibly a different way to view their conflict. My problem-solving and risk management skills are useful in mediations to help clients find their own solutions, not ones imposed on them or someone’s best guess at a very variable outcome (trials are empirically roughly a 50-50 crapshoot and studies show most litigants are wrong in their assessments of their own cases).
As an arbitrator, I look toward fairness and equity. Certainly the law has a place in an arbitrator’s decision-making process, but the law cannot address everything in life. All sides get the opportunity to fully present their case.
