There are about 6 states that still have “alienation of affection” statutes on the books, including Mississippi. In 1997, Sandra Valentine began working for Jerry Fitch, a wealthy Mississippi realtor and successful businessman. She ended up having an affair and child with her new boss. After divorcing her husband, she married him.
However, her husband did not take this lightly. He sued Fitch under an antiquated state law permitting a cuckolded spouse to seek damages for “loss of society, companionship, love and affection,” as well as “the loss of sexual relations.” A jury awarded the husband $750,000 which has been upheld on appeals all the way to the US Supreme Court.
